Many of the potential defenses in a DUID case are the same as those for DUI. Lack of probable cause for the police to stop you, your actual driving behavior or other factors could provide the key to a successful outcome. In a marijuana-related case, a urine test will not reveal the presence of active THC during the period you were driving, and it may be possible to challenge the results of a blood test on similar grounds. If you refuse to submit to a chemical test in a DUID case, you may lose your drivers license for one year. If you submit to a chemical test in a DUID case, the Dept. of motor vehicles cannot revoke your driver's license.
